Key Approvals And Contracts Required For A Wind Farm Project In Vietnam

Below is a list of key approvals and contracts required for a wind farm project in Vietnam (the Project):

  • Permission by provincial People’s Committee for the Project to carry out wind measurement;

  • Report on wind measurement result to the provincial People’s Committee;

  • Approval of the Pre-Feasibility Study of the Project;

  • Approval of the basic design part of the Feasibility Study of the Project;

  • In-principle Approval of the Project under the Investment Law 2014;

  • Investment Registration Certificate of the Project under the Investment Law 2014;

  • Signing of Grid Connection Agreement (Thỏa Thuận Đấu Nối), (2) SCADA/EMS Agreement, (3) Agreement on the protection and automatic relay system, and (4) Power Purchase Agreement with EVN or its subsidiaries;

  • Signing of an Escrow Deposit Agreement with the provincial People’s Committee in accordance with the Investment Law 2014;

  • Approval of the height of the proposed construction works of the Project;

  • Approval of the Fire Fighting and Prevention Design of the Project;

  • Approval of the Project’s Environmental Impact Assessment Report;

  • Construction permit for the Project;

  • Land Lease Decision, Land Lease Agreement and Land Use Right Certificate for all of the Project’s land;

  • Approval for road transportation of super heavy and super tall structures;

  • Issuance of the Electricity Generation Permit for the Project;

  • Acceptance minutes approving the satisfaction to the Fire Fighting and Prevention Design of the Project; 

  • The acceptance result on completion of construction for putting the Project into operation;

  • Approvals/registrations (if required) in relation to environmental issues, including (i) registration on generation of hazardous waste; (ii) permit for discharging waste water; (iii) permit for exploiting and using surface water; (iv) permit for exploiting and using underground water; and (v) registration on use of dangerous chemicals (if any); and

  • The Certificate of completion of environmental protection works of the Project.
